It is the end hirer’s obligation to complete an IR35 audit and determine whether their contractors are genuinely self-employed or operating like a “disguised employee” for tax purposes. Along with the responsibility of auditing workers, the associated tax risk is also the hirer’s responsibility, meaning if not done correctly they will end up having to pay any unpaid taxes, as well as fines and/or penalties.

The Government require hirers to take “reasonable care” when assessing roles filled by a contract worker. Many hirers will not have the expertise in house to apply the IR35 legislation and to meet this requirement.
