IR35 Compliance for Recruiters

The IR35 employment assessment obligation, and the associated tax risk, has moved. Since 2017, in the Public Sector, that obligation and risk now sits with the hirer and agency. The Government has confirmed that similar changes will apply in the Private Sector from April 2021.  Hirers, most of whom do not have an adequate understanding of the new rules to meet the “reasonable care” threshold set by HMRC, are looking to their agencies for help.  In many instances, agencies will have a contractual obligation to ensure that the workers they are providing are “compliant” and do not expose the client to risk. However, IR35 is a niche area of law and many agencies do not have the necessary understanding of IR35, and the employment tests behind it, to give good advice to their clients.  This is where Brookson Legal can help.

Business Solutions for Recruiters

Brookson Legal is working with a fast-growing number of agencies to support them and their clients with the changes to IR35.

We put together bespoke education packages, explaining the new rules to agencies and their clients, through presentations, seminars and webinars.

We are working with agencies today to help them understand the employment status of their contractor candidates.  We are also working with hirers, introduced to us by their agencies, to help them audit their flexible workforce, so that they understand the changes that need to be made ahead of April 2021.

Agencies and clients working with Brookson Legal benefit from an IR35 helpline which responds to queries from agencies, hirers and contractors with fast and clear advice, given by IR35 experts.

Agencies working with Brookson Legal are able to position themselves as their clients’ “compliance partner”, bringing to them a commercial and pragmatic approach to the legislation, and often winning new business from less proactive competing suppliers.
