IR35 Compliance for Recruiters

The IR35 employment assessment obligation, and the associated tax risk, has moved. Since 2017, in the Public Sector, that obligation and risk now sits with the hirer and agency. The Government implemented a similar change to the Private Sector in April 2021. Hirers, who are now responsible for meeting the “reasonable care” threshold set by HMRC, are looking for ongoing support from their agencies. In many instances, agencies will have a contractual obligation to ensure that the workers they are providing are “compliant” and do not expose the client to risk. However, IR35 is a niche area of law and many agencies do not have the necessary understanding of IR35, and the employment tests behind it, to give good advice to their clients.
